WIKILIEAKS IRAQ WAR LOGS: LEGAL ACTION IS UNAVOIDABLE

http://usgenocide.org/2010/wikileaks-iraq-war-logs-legal-action-unavoidable/

PRESS RELEASE

For immediate distribution

Date: 30 October 2010

WIKILEAKS IRAQ WAR LOGS:
LEGAL ACTION IS UNAVOIDABLE

To all victims of the US-UK invasion of Iraq and their families,

To all Iraqis,

To all Parties of the Genocide Convention, the Four Geneva Conventions and the UN Convention against Torture,

To all progressive lawyers, legal associations and institutions, parliamentarians, international civil servants, and everyone who supports legal action to ensure redress for Iraqi victims of US-UK crimes:

Just over a year ago, we submitted a legal case before the Audencia Nacional in Madrid under laws of universal jurisdiction against four US presidents and four UK prime ministers — George H W Bush, William J Clinton, George W Bush, Barack H Obama, Margaret Thatcher, John Major, Anthony Blair and Gordon Brown — on charges of war crimes, crimes against humanity and genocide in Iraq. This case was based on our analysis of hundreds of documents available in the public domain, along with firsthand witness testimony that informed our effort and our designation of US-UK actions as genocide.[i]

The essence of our case was that the accumulated pattern of harm, stretching over 19 years, revealed a clear and specific “intent to destroy”, in whole or in part, the state and nation of Iraq. We catalogued the purposive dismantling of the Iraqi state and the imposition, incitement and engineering of sectarian conflict. We also described the systematic destruction of Iraq’s civil infrastructure, added to the massive use of depleted uranium, which from 1990 onwards led to millions of excess deaths. We outlined the use of disproportionate and indiscriminate force, the use of internationally prohibited weapons such as white phosphorus, and the use of prohibited means and methods of warfare. And we identified the use of death squads and armed militias associated with political forces promoted by and protected by Washington, the terror that led to the forced mass displacement of five million Iraqis, and the institutionalised regime of mass and arbitrary detention and torture, along with blackmail, kidnapping, rape and unfair trials, that characterised Iraq under US occupation.

The Wikileaks disclosure
The near 400,000 classified documents that Wikileaks recently published substantiate the claims we made in our case and constitute official US evidence of elements of the case we presented: the existence in Iraq of a regime of systematic torture; rape used as a weapon of warfare and terror; incidence of arbitrary, summary and extrajudicial executions; the routine use by US armed forces of indiscriminate and disproportionate force; the alarming collapse of the division between military and civilian targets, with two thirds of the victims registered in the leaked documents being acknowledged as civilians. We will add these documents to our archive of evidence.

But these documents alone must be situated. While adding to the picture of the real war conducted, they do not contain it.

1. Inevitably, the leaked documents tell the story of the Iraq war from the perspective of — and within the confines of — the US military and its record-keeping practice. One cannot expect this practice to be anything but influenced by US Army culture and the operational goal of winning the war.

2. The leaked documents do not cover the actions of the CIA and other non-US Army agencies in the Iraq war, or similar agencies of foreign powers.

3. The leaked documents do not cover the role or actions of US security contractors, or mercenaries, in the Iraq war, which were granted legal immunity by the US occupation.

4. The leaked documents do not cover the role or actions of sectarian militias and death squads linked to foreign states and political forces in the US-sponsored and vetted political process, and that conducted campaigns of ethnic cleansing and crimes against humanity targeting Arab Sunnis, Turkmen, Christians, Yezidis, Sabeans, and Shabak as such, and even innocent Shia, in addition to the systematic assassination of middle class professionals.

5. The leaked documents provide raw data on day-to-day operations but do not contain information on the strategic planning or aims of the war.

6. The leaked documents only cover self-reported incidents, while the body count overall only encompasses the dead the US Army recovered.

7. The leaked documents do not collate the overwhelming bulk of the killing in Iraq, which involved militias incorporated into the new Iraqi Security Forces led by Iraq’s puppet governments — among which that of Nouri Al-Maliki — and for which the US, as the occupying power, is legally responsible.

8. The leaked documents do not cover the orchestrated plunder of national and individual property, individual appropriation of state property, arbitrary dismissal and refusal of work, and the mass non-payment of salaries and withdrawal of social rights. Nor do the documents shed light on the collapse of Iraq’s economy, and the consequent mass impoverishment and displacement of Iraqis.

9. The leaked documents do not cover non-violent excess deaths in Iraq, whether the result of the collapse of Iraq’s public health system, the contamination of Iraq’s environment, including by radioactive munitions, and the spread of disease amid the overall collapse of all public services, including provision of electricity, a functioning sewage system, and clean water.

10. The leaked documents do not shed any light on the trauma induced by the US-led war on individual Iraqis and the Iraqi nation as a whole.

Demand for legal action
At present, there is a full-scale damage limitation effort ongoing, headed by the US Pentagon and involving: attempts to focus attention away from the detail of the leaked documents and onto the founder of Wikileaks and his person; to focus attention on the failure to act against torture when it involved Iraqi police and paramilitary forces, ignoring US practices of torture or the culture of violence the US occupation has promoted overall (including by specifically training and arming death squads and militias); and to divert attention to the role of Iran while failing to contextualise the cooperative relation between the United States and Iran in the destruction of Iraq.

Despite US manoeuvres, the United States administration and the government of Iraq stand equally accused. Neither can be trusted to investigate the facts contained in the classified documents Wikileaks has brought into the public domain. Only action that invokes the universal jurisdiction of the conventions the US and Iraqi governments have violated in Iraq can be satisfactory and objective. And only by stepping back and reviewing the whole period, from 1990 through until now, can one adequately situate the Wikileaks Iraq War Logs and understand their importance.

Wikileaks has done a tremendous service to truth in times of war, and has placed before us raw evidence that is compelling, undeniable, and that tells — in part — the story of the Iraq war in a way until now untold. We salute Wikileaks and its sources for the courageous act of releasing the classified Iraq War Logs. We call on all lawyers, judges and juridical institutions to display equal courage, and in coalition to work towards the swift prosecution of US and UK war crimes, crimes against humanity and genocide in Iraq. We believe that only by coordinated action can those responsible for grave crimes and rights violations in Iraq be held accountable.

We therefore call for the formation of an international coalition of lawyers, legal specialists and antiwar and anti-occupation progressive forces to realise this obligation.

We are ready to cooperate with and join any effort that aims to ensure redress and reparations for Iraqi victims of US and UK crimes.

There is no excuse now for failing to take legal action everywhere it is feasible, both at the national level — where the universal jurisdiction of international conventions permits — and beyond. But legal action must be informed by an analysis of the nature of the war as a whole, and by the testimony not only of the US Army, but also Arab and international solidarity groups and associations, and foremost the Iraqi people — the victims of the US-led war of aggression on Iraq.

Amerika Birleşik Devletleri, Birleşik Krallık ve müttefikleri Irak’a karşı yasa dışı saldırı savaşı yürüterek topraklarını işgal ettiler.

UN First Committee sends clear message to depleted uranium users over transparency

The United Nations First Committee has voted, by an overwhelming margin, for state users of depleted uranium weapons to release data on where the weapons have been used to governments of states affected by their use.

29 October 2010 - ICBUW

136 states last night voted in favour of a resolution calling on state users of depleted uranium weapons to release quantitative and geographical data to the governments of affected states. The resolution will now go forward to the United Nations General Assembly (UNGA) for a second vote at the end of November.

Although UNGA resolutions are non-binding, they are a useful means of focusing attention on key issues. In this case the ongoing failure of the US to release data on its use of depleted uranium in Iraq and concerns over the use of the weapons in other conflicts, such as the interventions in Somalia in the mid-1990s. The resolution was submitted by Indonesia on behalf of the Non-Aligned Movement.

The resolution was opposed by only four states - the US, UK, France and Israel. These four also voted against previous resolutions accepting that DU has the potential to damage human health (2007) and calling for more research in affected states (2008).

The number of abstentions was down from previous years, with Belgium, Bosnia & Herzegovina, Greece, Luxembourg and Slovenia shifting position to vote in favour. It is notable that Bosnia had to wait six years for NATO to reveal that DU had been used there and even now there are contaminated sites in the vicinity of Sarajevo for which NATO has still failed to release data.

As with previous years, NATO was split on the issue with Austria, Belgium, Germany, Greece, Finland, Iceland, Italy, Luxembourg, Norway, Slovenia and the Netherlands voting in favour, while Albania, Bulgaria, Canada. Croatia, Czech Republic, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Portugal, Romania, Slovakia, Spain, Sweden, Turkey and Ukraine abstained. Meanwhile Ireland, Malta and Switzerland all voted in favour.

In the Asia-Pacific region, ICBUW welcomed the ongoing support of Japan and New Zealand but was disappointed to see repeated abstentions from Australia and the Republic of Korea.

Elsewhere the abstentions from Georgia, Kazakhstan, Kyrgyzstan, Moldova and Russia, continued and ICBUW was disappointed that Albania, Macedonia and Croatia remained the only Balkan states not to support the draft.

"Overall we are pleased with the outcome of this vote," said an ICBUW spokesperson. "The text draws attention to a crucial issue that governs the humanitarian and environmental impact of uranium weapons - transparency. Nevertheless it is disappointing that many EU and NATO members who promote transparency in other areas of arms control are continuing to abstain.

Similarly the US, France and UK's ongoing refusal to play a constructive role in these votes is depressing. The UK's position in particular is looking increasingly hypocritical, given that the text asks for less than they have already undertaken of their own volition in Iraq."

If your government has failed to vote in the way you would like, there is still time to lobby them before the General Assembly vote - although a shift in position is rare, it is not unprecedented. For advice on lobbying your government, contact ICBUW.

12. 14 Temmuz 1959 Yılında Kürtler hazırlık görerek Altunköprü kasabasına saldırı yapmaya plan çizerek Peşmergeler üç gün bekleyerek, bir türlü Altunköprü’ye giremediler çünkü Türk milleti tüm güçleriyle karşı durmaya ölmeye can, kan vermeye toprağa, bayrağa ant ederek bir yabancını Altunköprü’ye girmesini yasaklayarak engel durdular. kadınlar, çocuklar yaşlılar bile hazırlık görerek her türlü kollanan aletleri eve bırakarak gece gündüz uyumadan uyak kaldılar, beklediler gelenleri saldıranları yok etmeye tüm insanlarımız birleştiler böylece düşman Altunköprü’ye korkudan giremediler.

Saddam’ın acı olaylarından (Altun Köprü. Irak Türklerini azınlık gören tüm millet örgütler nerde idi bilsinler ki bizler Irak’ın her bir yerinde varız ve Irak bizimdir kimsenin değil bizleriz Irak’ın kültürünü, tarihini, şeref, töresini koruyan en eski ve büyük millet bizleriz, her şeyimiz belli, nerde, kim bu zavallı insanların hakkını alacak uluslararası örgütler neredeydi, İnsan hakkını savunan Birleşmiş Milletler bu hakkı neden niçin savunmuyorlar? Siyasi teşkilatların görevi nedir? yeni çağda din, ırk ayrımı yapılmadan insanlar sevgi,,barış güven içinde yaşama arzusu duyarken talihsiz, kimsesiz bu millet kanlı ve korkunç olayları yaşaması acaba haksızlık değil mi?

Milletimize karşı baskısı önüne gelen her şeyi yıkıp, yıkıp, Türkleri berbat perişan etmiştir.

17. Ne zaman zalimlerin hesabı sorulacak?

Uluslararası adalet mahkemesi ve adalet yerin bularak Saddam cezalandı ve hakkını alarak şehitlerimizin kanları yerde kalmadı..ve Türk milletine karşı çıkan başka düşmanlarla, böylece utanç verici olaylardan kıyıcı rejim Türkmen halkına Altunköprü Milletini tedirgin edip korkuda yaşatıyorlar Saddam gibi Altunköprünün adını değiştirmeye kalkıyorlar yüzlerce Kürt aileleri ilçeye bölgeye yerleştiriyorlar .

işkence , güç , idam, Kurşuna dizmekle bu Türk milletini yok etmek silmeye çalışmaktadır, artık Saddam’ın yok olmasıyla tüm düşmanlarda bir gün yok olacaklar.

WikiLeaks reveals private security contractors killed Iraqis with impunity

By Tom Eley 27 October 2010

WikiLeaks’ release of nearly 400,000 US military documents from operations in Iraq between 2003 and 2009 brings to light new evidence that private security contractors killed civilians with impunity.

The armed contractors, who directly serve the interests of the US occupation, now number 40,000 in Afghanistan and Iraq. These numbers are set to increase substantially; in August it was announced that the Obama administration intends to double the number of private mercenaries in Iraq, as it reduces the number of soldiers under US uniform in the Obama administration’s “draw-down.”

The mercenaries, some of whom earn more than $500 per day, are accountable to no one. Soon after the US invasion of Iraq, Paul Bremer issued “Order No. 17,” giving security firm employees total immunity from Iraqi laws. Nor has any US court punished the contractors, even for known instances of murder. They are also not under the jurisdiction of the US military, freeing them from the court martial and even the often-flouted rules of engagement laid out in the US Army Field Manual.

WikiLeaks documents analyzed by Al Jazeera, the Arab-language media service, reveal at least 14 previously unknown cases in which employees of the most infamous private security firm, Blackwater International, fired on civilians. These attacks resulted in 10 confirmed deaths and seven serious injuries.
Blackwater, now known as Xe Services, is most notorious for a 2007 attack it carried out in Baghdad’s crowded Nissour Square, killing 17 civilians and seriously wounding 18 more. Five Blackwater mercenaries were charged with murder, but a US judge ruled the prosecution had engaged in misconduct and threw the case out.

The documents, field reports from US soldiers, reveal that Blackwater carried out many other killings that were not acknowledged by the US military or the Iraqi government, and that went unreported by the western media.
In February, 2006, as Blackwater mercenaries were escorting US diplomats through Kirkuk (part of a $465 million contract the State Department had awarded the firm), they opened fire on civilians, killing two. Protests erupted in Kirkuk after these murders.

In May of 2006, Blackwater guards let loose “uncontrolled fire” in north Baghdad, killing an ambulance driver, Jasem Abed Sarhan. The shooting apparently came as blind retaliation for their vehicle hitting a roadside bomb. After the killing, Blackwater refused to cooperate with a US army investigator.
In May of 2005, US soldiers witnessed Blackwater contractors “shoot up a civilian vehicle,” along the “Route Irish,” the code name for the road to the Baghdad airport, before speeding off in a white armored vehicle. The driver of the civilian vehicle was killed, and his wife and daughter were maimed. The field report noted that the contractors also fired in the direction of the US soldiers during the incident.

In April 2006, US soldiers came upon the scene after Blackwater mercenaries had gunned down three civilians in Baghdad. Blackwater guards claimed they had been engaged in a shootout with insurgents, who had escaped.
No Blackwater mercenary has ever been punished for killing an Iraqi. Only Monday the US Justice Department announced it was dropping charges against Andrew J. Moonen, a Blackwater employee who killed the bodyguard of an Iraqi Vice President on December 24, 2006. Moonen has admitted to being drunk at the time of the shooting, which took place in Baghdad’s Green Zone.

Blackwater, since February of 2009 known as Xe Services, still receives lucrative CIA and State Department contracts. On October 1, the Obama administration renewed Xe Services’ Afghanistan contract for another five years. The next day, the US-controlled Afghan regime of President Hamid Karzai banned it and seven other private contractors from operating in the country, in a bid to ease popular anger against the Kabul government’s complicity in crimes against the population.

Blackwater was not the only private security firm that killed and brutalized Iraqis. According to the Guardian, which also analyzed the newly-released documents, in terms of the number of incidents uncovered in the WikiLeaks documents, Blackwater is “closely followed by Erinys, a British private security company registered in the Virgin Islands, which seems to have an unusually high number of vehicle crashes.”

The New York Times also found incidents of security contractors attacking civilians. Mercenaries working for the Romanian firm Danubia Global killed three Iraqis in Falluja in 2006, “then refused to answer questions on the episode,” it reports.

According to another military report, in July 2009 contractors with a firm known as 77th Security Company entered a neighborhood in the northern city of Erbil and began a shooting spree. This set off a gunfight with an off-duty police officer, during which three women were wounded. The field report concluded that “this drunken group of individuals” was “out having a good time and firing their weapons.”

As chilling as the new revelations are, they vastly underestimate the number of killings by private security firms. Firstly, they include only instances in which US soldiers directly observed the contractors in action, or came upon the scene soon after violence had been committed.

Secondly, as Pratap Chatterjee of the Guardian notes, field reports on mercenary attacks appear to understate their gravity.
Chatterjee was surprised when he could not find information related to the Blackwater massacre in Nissour Square. “Eventually, I tracked down the incident by trying a few other methods,” he writes. “It is easy to see why I missed the record: there is no mention of the company, or the location, and even the death toll is incorrectly recorded as nine, suggesting that the Pentagon casualty record is incomplete.”

He continues, “Quite possibly, there were many more incidents in which civilians were injured, or even killed, which were never reported. Some of the reports may have been altered before they were entered into the military system. But given the other records that I found, at the very least, WikiLeaks has revealed that Blackwater and other private security companies are guilty of many more injuries and killings than the media have previously reported.”
In contrast, the American press has sought to shield the private security companies.

The New York Times article concerns itself primarily with the dangers the mercenaries themselves confronted. It notes the frequency with which US or Iraqi government troops accidentally fired on the contractors’ speeding vehicles, generally unmarked SUVs and pickup trucks; the many traffic deaths among contractors; deaths resulting from IED explosions on their unarmored vehicles; instances in which confused mercenaries wound up accidentally shooting at each other; and two cases in which contractors murdered their own colleagues.

Though killings reported by Al Jazeera had not been previously reported, this did not stop the American media from claiming the opposite. In its Tuesday editorial, the Washington Post asserted that all “the incidents were extensively reported by Western journalists and by the US military when they occurred.” This shameless lie is designed to hide the Post’s complicity in the cover-up of these and countless other crimes against the Iraqi people.

Significantly, security firms are taking measures to defend themselves against charges of war crimes. On Tuesday two requested that a federal appeals court grant their employees immunity from lawsuits brought by torture victims and bereaved relatives of victims murdered at the notorious Abu Ghraib prison in Iraq.

Lawyers for L-3 Communications of New York and CACI International of Virginia argued that “war on terror” rules—which prevent US soldiers and intelligence operatives from being sued in US courts—should apply to private firms working under government contracts.

“Myths of Nuclear Power – A Guide”

The myth of nuclear power keeps persevering: lobbyists and politicians will not tire of praising nuclear power as an unlimited, cheap and secure energy source. As a matter of fact the number of nuclear power plants in the world is continually decreasing. Cost estimates for new nuclear plants have been escalating at an alarming rate and up to now, they have been funded by massive public subsidies. The newest myth paints nuclear power as the necessary bridging technology to the renewable future, thus ignoring the fact that nuclear energy and renewable energies de facto compete for a meagre amount of investment capital and power-lines. Many systemic issues have not been thoroughly investigated yet when it comes to compatibility or incompatibility of the centralised nuclear approach versus the decentralised efficiency+renewable strategy: What are the consequences for grid development or how do choices on grid characteristics influence power generation investment strategies? How do government grants/ subsidies stimulate long-term decision-making? Will large renewable power plants reproduce the same system effects as large coal/nuclear plants?

The Heinrich Boell Foundation has asked renowned international scholars from both sides of the Atlantic to prepare reports which challenge these and other “nuclear myths”. This overview provides for a current, facts rich and nuclear-critical know-how.

What the WikiLeaks leaks don't reveal

The Wikileaks revelations provide a further window into the destruction wrought upon Iraq by the war and occupation and show how Iraqi loss of life has been seriously understated and US and British cruelty grossly under-reported. But, says Kamil Mahdi, the documents still don't give a complete picture of the devastation that has been inflicted on Iraq and its people.

By Kamil Mahdi
Iraqi academic based in Britain and Fellow of the Transnational Institute in Amsterdam 24 October 2010

For Iraqis, the new batch of leaked US military logs merely confirm their lived experiences of the brutality of the US/British occupation of their country.

The gratuitous nature of much of the violence and abuse committed by US troops was and remains to a lesser degree a daily experience of Iraqis.
This culture of violence and abuse seamlessly merges with a military practice that places almost no value of Iraqi life, including that of civilians.

The leaked and reported documents show the flimsy bureaucratic cover-up for occupation violence in its daily routine. The leaks reveal beyond doubt the direct responsibility of occupation forces for much and perhaps most of the violence in Iraq, as perpetrators or as ever present and enabling witnesses to local units the occupation has fostered and which it continue to protect, support, train and “mentor”.

The newly reported atrocities add to general US and British responsibility and to that of their local political allies for the climate of chaos and violence resulting from the invasion and occupation of Iraq, with its myriad failures in the provision of basic security, essential services, economic regeneration, and a enabling constitutional and administrative framework to end the crisis in Iraq’s society.

The abuse reported in these leaks, in addition to all previously known US and British crimes, should serve as a reminder that the elements of communal violence (as distinct from regime repression and terror) experienced in Iraq in recent years are incidental to the occupation itself.

The occupation and the destruction of the state pushed Iraqis to seek protection within their communities and the new institutions set up were based primarily on the notion of sectarian and ethnic identities. Instead of investigating abuses and seeking to punish perpetrators and protect citizens, the logs show that occupation forces terrorised the Iraqi people and empowered bigots. The occupation has acquiesced in massive population displacement, and proceeded to construct concrete walls to separate communities, even without an initial approval from the Iraqi government, thereby creating an environment that is hostile to democratic and nationalist political forces. This is the root of the stumbling sectarian political process, and the background to the growing repression and violent behaviour of the new Iraqi security forces that have been operating alongside US troops.

Death squads
What these leaks do not yet reveal, however, is any detail of the operations of death squads that have been responsible for the murder of tens of thousands of Iraqis, purely on the basis of communal identity, murders that weigh heavily on the current political and social outcome in the country.

Nor do the leaks show the identity of these organised death squads, or reveal any links to US Special Forces which continue to operate in Iraq which have historically been involved with death squads elsewhere.

The activities of mercenaries, the so-called Security Contractors, also do not feature in the reports of these leaks so far.

In other words, these leaked documents cannot show a complete picture of the violence and the manner in which it has been utilised politically in order to achieve political and economic ends.

They do, however, provide a further window into the destruction wrought upon Iraq by the occupation, and reveal that official statistics and media based tallies of Iraqi casualties such as the Iraq Body Count seriously understate the true extent of human losses, and that the foreign media has seriously under-reported both the extent and the cruelty of US and British violence against Iraqis.

The leaks show the low premium assigned to the lives of Iraqis in this alleged “Operation Iraqi Freedom”, and many Iraqis will be making the comparison between the militarily unwarranted destruction of Iraqi lives and the recent agreement by the US-dependent Iraqi Government to pay a total of $400 million of reparations to a few dozen US citizens who had suffered relatively minor infringements of their liberties under the former Saddam regime in 1990 and 1991.

The Iraqi government of Nouri Al-Maliki has protested that the leaks are politically motivated and timed to embarrass the current caretaker Prime Minister himself, and to undermine his chances of remaining in office. If so, the timing might have been more effective a few months ago, before Maliki had built up momentum for remaining in office by proceeding with the implementation of oil contracts that undermine Iraq’s sovereignty over its resources, and by building up regional and international support for his candidacy and making more concessions to the US and to their closest local allies.

The leaks show very clearly that there is very little judicial oversight of the new Iraqi security forces which engage in rampant torture, ill-treatment and murder. While again, this does not come as a true revelation to Iraqis who are at the receiving end of this abuse, it highlights the question of independent as opposed to political control of the internal security forces. This issue is now one of those hampering the formation of a new government more than seven months after the March 7 elections.

However, the main problem in Iraq will remain that the United States continues to insinuate itself in internal Iraqi affairs through iniquitous agreements and by other means, and no one can trust the political independence of the security forces while there remain thousands of US troops in a country they occupied and abused.

Joint Statement by various YEZIDI Communities regarding the YEZIDIS in Northern IRAQ

Joint Statement by various Yezidi Communities

Recent Kurdish media reports and seems to be very interested about the Yezidis’ ethnicity, so the KRG in northern Iraq has exposed an escalating conflict among the innocent Yezidis in Northern Iraq and particularly in Sinjar regions. Several Kurdish political leaders including junior mullah Barzani have expressed that the innocent Yezidis are Kurdish and must be Kurdified; therefore, this expression has increased the tension and will be going as far as a very possible civil war between the two Yezidis groups: “The Yezidis who consider themselves as ‘Yezidis ethnically and religiously” and “the Yezidis who have accepted the ‘kurdification’ and consider themselves as ‘Kurdish’ in ethnicity.”

Mr. Tahsein Saed, who consider himself as the Yezidis’ prince in Iraq and around the world; he and four other members of his team who pretend themselves as religious leaders of the Yezidis on Tuesday, September 21, 2010, they (Tahsein Saed, Khato Esmael, Slaeman Sivo, Barakat and pishmam Faroq) issued and signed a statement for the Kurdistan Regional Government (KRG) stating that all the Yezidis are Kurdish! We, herein the under singed Organizations disapprove their statement and also most of the Yezidis in Shaykhan (prince’s own region) disapprove the statement that was issued by these traitors. Even though Mr. Tahsein Saed is only the prince of Shaykhan and he does not represent all the innocent Yezidis in Iraq, around the world and particularly the Yezidis in Sinjar region at all, because this prince (perpetrator) is “not” our prince; we strongly disapproved their statement while we see them as traitors / perpetrators and just trying to selling our peaceful Yezidis’ culture/ethnicity for money and personal interests.

However, the prince was an Arab in ethnicity in the past during Saddam Hussein’s regime; presently he is Kurdish under KRG or junior mullah Barzani’s regime and in the future???

Even though, during the previous Iraqi regime of Saddam Hussein, the same dictator/ defector (Prince Tahsein Saed) issued and signed the same statement for Saddam stating that all the Yezidis are Arabs in ethnicity. Therefore, we see this Perpetrator (Tahsein Saed) is really mentally ill for the sake of money and personal interests. Whatsoever, our nationality/ethnicity is very important for all of us (the remaining innocent Yezidis ethnically and religiously); we are human being and not “material products” to be bought/sold by defectors such as Mr. Tahsein Saed and his team members.

Therefore, “We (The under signed Organizations) want to make it clear for the world, world leaders and International Communities that Mr. Tahsein Saed does not represent all the Yezidis in Iraq and around the world (he is only the prince of shaykhan region). He does not represent the innocent Yezidis in Sinjar regions at all!” Presently, Mr. Tahsein Saed only represents those Yezidis who “joined” the Kurdish culture and accepted “Kurdification” with him. Despite all their bad behaviours towards “the innocent Yezidis,” we ‘congratulate’ Prince Tahsein Saed and his followers in their new path of life; they are free to make choices for themselves for whatever they want to be, but “not” for all of us (The innocent Yezidis)!

In the past two decades, the Kurdish leaders have always failed to recognize the true nature of the Yezidis ethnicity as a distinct ethnic group from the Kurdish, because of their political and geographical interests. In many of these so called disputed areas there were very few Kurds to be found before the fall of Saddam Hussein (previous regime). In the Nineveh plain for example, the percentage of Kurds was less than 5%, but now, they have expanded their new Kurds settlements into the disputed areas (Nineveh, Kirkuk and Diyala provinces) by hundreds of thousands of new Kurdish settlers illegally and by militia forces while they see Central government is weak. The KRG and its leaders are doing all of these evil tactics in these areas to annihilate our ancient history and to be annexed to the KRG, this should be very clear to the International Communities. In fact, the stretch of land bordering line with the KRG is mostly dominated by the Yezidis, Chaldo-Assyrians, Turkmens Shabaks and Kakais. Instead of acknowledging this fact Kurdish political groups have launched a violent campaign to describe the innocent Yezidis and other minority such as Shabaks as Kurds in ethnicity while we are totally culturally different from the Kurdish; forcing Kurdification on us (Yezidis) against our will is crimes against humanity and human rights are being committed by the KRG Officials and its militia forces in the disputed areas.

The KRG and its militias are today used to instil fears in minority communities inhabiting border areas with the KRG in order to ensure compliance with KRG expansion technique while oppressed in the past, at present the KRG’s regime is much worse than Saddam’s regime, the Kurds have grown and become themselves the new dictators / oppressors in Iraq especially in the disputed areas seen from our perspective. Any census in the near future (December 5, 2010) of disputed areas carried out under KRG and its militias’ presence will not be free and fair, as we have seen the KRG and its evil tactics during the past federal and provincial elections, when one person voted for more that ten times and we have evidence of that. Therefore, we ask the US, UN, UK, EU, Russia and all other International Communities that the census in the disputed areas must “NOT” be conducted with the presence of the KRG and its militias (bloodshed creators), the census “must” be conducted with International Communities’ presence in everywhere in the disputed areas, “if the International Communities have faith in freedoms and democracy.”

While most of Iraq is becoming secure for all Iraqis, including vulnerable non Muslim communities such as the Yezidis, Chaldo-Assyrians, Kakais and Bahais, the clear and violent expansion plans of the KRG has been threatening to destabilize Iraq, its neighbouring countries and severely affect all of us (the vulnerable Iraqi minorities) who live in the disputed areas that are being violently claimed by the KRG and its dictatorial regime. From being a centre of stability the KRG has turned into the major source of instability in Iraq since 2003 and continues its violent aggression acts in every part of the disputed areas.

We the undersigned Organizations are calling upon the US Congress and the Department of State of religious and ethnic freedom, UN, UK, EU, Russia and all other International Communities to put pressure on the KRG to refrain from all acts of crimes and violence against innocent Yezidis and all other Iraqi minorities and withdraw its militia forces from all areas outside the KRG and “STOP” describing the remaining innocent Yezidis as Kurds, because we are NOT!

We also call on Kurdish leaders to respect the rights of all minorities and including the remaining innocent Yezidis as distinct and independent religion and ethnic group.

US soldiers assassinated a Turkmen Family in Telafer

REPOSTED

A photographer embedded with the First Brigade of the 25th Infantry Division in January 2005, in Tal Afar, north-west Iraq, witnessed the deaths of Camille and Hussein Hassan, who were travelling with their six children.
Rakan Hassan, 11, was shot in the spine and paralysed – and his family was offered just $7,500 (£4,782) in compensation by the US Army for the loss of the two parents at $2,500 (£1,594) each, and an extra $2,500 (£1,594) for damaging the car.

IRAQ - The Bid Round for the Next Iraqi Government: Why Don’t They Just Get On With It?

In a small triumph for Iraqi democracy, the country’s federal supreme court today ruled that parliament had to end its “open session” and get on with the election of a proper speaker, “within 14 days” according to some reports, so that parliament could resume its supervisory functions in keeping with the principle of democratic separation of powers. The challenge had been mounted against the temporary speaker of parliament, Fuad Masum of the Kurdistan Alliance, by a non-governmental organisation.

It is however unclear whether the ruling will actually prompt any fast response by Iraqi parliamentarians. It should be stressed that what the main factions are currently doing, i.e. postponing the election of a parliament speaker until the architecture of a more comprehensive deal including prime minister and president is ready, is not in line with the constitution. However, since all the big parties have major stakes in finishing a comprehensive deal, only small parties, like Tawafuq, have so far shown an interest in the idea of an early election of a speaker.

But even when it comes to the bigger parties, it is really hard to understand why there should not be at least a premier nominee within a week or two. This is so because the current phase of the government-formation process, “the Kurdish drama”, is playing out in a slightly different way than expected after the surprisingly large anti-Maliki defections from the putative all-Shiite National Alliance left the Kurds with a kingmaker role they otherwise would not have had. Due to this development, the two competing formations of parties – i.e. the rump NA headed by Maliki, and Iraqiyya in a tactical alliance with ISCI and with Adil Abd al-Mahdi as premier candidate – have opted to take an uncritical approach to the Kurdish list of 19 demands, to the point where it seems clear that they are promising a lot more than they can ever deliver. Right now, the only potential problem seems to be that there could be some kind of draw whereby both Maliki and Allawi/Abd al-Mahdi promise to implement all of the 19 points! In that case personality and trust issues will necessarily come to the fore, and the Kurdish ranking seems to be 1. Abd al-Madhi; 2. Allawi; 3. Maliki; certainly as far a Masud Barzani is concerned. Still, Jalal Talabani, the Kurdish leader closest to Maliki, seems to be weakening the strong Kurdish position somewhat by his insistence on keeping the presidency for himself.

Again, the idea that the 19 Kurdish points will ever be implemented seems totally unrealistic. This is why any premier nomination is likely to be followed by a period of confusion as the impossibility of implementing many of the Kurdish demands will necessarily dawn upon key players as soon as a premier has been nominated. In particular, once settled in his spacious new office, the new president will discover that he has no power and can get no power except through a special vote in parliament followed by a popular referendum. Even a conservative estimate would indicate May 2011 as a realistic timeline for a process involving a vote in parliament, a referendum law, the referendum itself and certification of the result. And that assumes a Yes vote to the required constitutional change.

But again, as long as the fiction of the feasibility of implementing the Kurdish point remains, there is nothing that should prevent the Kurds from picking a winner within a week or so. One possible delaying factor could be the United States, which probably may still hold some leverage over the KRG president, Masud Barzani. It is conceivable that Washington is creating delays by either not answering the telephone due to the distractions of the 2 November midterm election, or by insisting on continued attempts to get all four major factions inside the next government, which means higher thresholds for finding agreement.

At any rate, more meetings between the Kurds and the two competing formations of parties have been scheduled for this week; all in all there simply is no longer any excuse for not getting on with it.

Iraq war logs: Apache helicopters kill 14 civilians in hunt for insurgents

by Jonathan Steele

'Gun runs' over Baghdad saw pilots blasting vehicles and buildings on the slightest suspicion

October 22, 2010

The full 39-minute WikiLeaks video, Collateral Murder, showing Apache helicopters killing two Reuters reporters and attacking other targets on dubious grounds

US Apache helicopters killed at least 14 unarmed civilians in a series of previously unreported "gun runs" in eastern Baghdad only four days after the notorious killing of two journalists and 10 other civilians that was captured on a leaked cockpit video released in April.

The footage obtained by the WikiLeaks website led to the arrest of Iraq-based US army analyst Bradley Manning, who is accused of being its source. Posted on YouTube, the 39-minute cockpit video shows three incidents in which people were targeted as they walked along Baghdad streets, sat in a van or went into a building, unaware that gunships were aiming to destroy them. Because the dead included two Iraqi journalists working for Reuters TV the US authorities mounted a rare investigation.

War logs examined by the Guardian reveal that a bigger incident with a greater number of casualties occurred in a neighbouring part of Baghdad four days later on 16 July 2007. This time the Apaches were aided by unmanned surveillance drones and two F-16 fighter-bombers as US ground troops stepped up operations in densely populated eastern Baghdad against militants loyal to the anti-occupation cleric Moqtada al-Sadr. When it was over a local Iraqi informer told a US army interpreter that 14 civilians were dead, according to a military intelligence report.

The bloody incident begins after two foot patrols from A Company of the 504th Parachute Infantry Regiment come under small arms fire. One patrol "clears" the nearby Islamic Bank and then comes under fire again from a building belonging to the electricity ministry. Ten minutes later the other patrol reports fire from small arms and rocket-propelled grenade launchers. Two Apache helicopters are called in, known in US military jargon as Crazyhorse elements 20 and 21, and both "engage the AIF" (anti-Iraqi forces). (The helicopter involved in the shooting four days earlier was Crazyhorse 18.)

Ten minutes later one of the helicopters fires at two more AIF targets and reports it is being shot back at. An Iraqi army patrol arrives with a US training team. A US foot patrol from A Company reports that a nearby mosque is calling insurgents out to attack the Americans. No source is given, but the patrol may have an Iraqi interpreter who can understand the voice from the minaret.
The helicopter pilots spot a crowd gathering who are described as "possible AIF". The second helicopter, Crazyhorse 21, "conducts final gun run" to strafe unnamed targets that the intelligence report does not specify. By now two F-16 fighter-bombers are on station along with an unnamed drone that is filming the scene. Four Bradley armoured vehicles full of US ground troops are at the ready nearby.

But there is no more firing from the Iraqis and the drone's video footage, which is being monitored by US controllers, shows people coming out of the mosque and dispersing. "No weapons were seen." US troops remain on the scene for another 50 minutes before returning to base.

It is not their practice to remove or identify bodies. If done at all it is usually left to Iraqis. In this case the war log on the incident ends with what are described as unconfirmed reports of casualties. An Iraqi colonel says 12 AIF are dead. A named Iraqi informer on the ground rings the Parachute Infantry Regiment's interpreter and tells him 14 civilians are dead.

It is not clear whether both men are referring to one group of dead with differing estimates of whether they were insurgents or civilians, or whether there were separate groups totalling 26.

The terseness of the war log, which was compiled some time after the event, conveys little drama – which is why the cockpit video released by WikiLeaks in April is so important. It shows the true face of war as pilots treat a small densely populated corner of a foreign city as a battle space in which any adult male they spot is suspected of being a gunman.

Even so they are not supposed to kill unless they or any ground troops they are assisting have come under fire, or they are sure a person seen to be carrying a gun is about to fire at US troops.

If rules of engagement are broken the war logs usually conceal it. This appears to have happened with the killings illustrated in the leaked cockpit video. The Guardian has examined the secret intelligence reports for 12 July 2007 and compared them with the recorded words of the pilots and ground commanders. Parts of the video recording already showed the helicopter pilot and gunner giving false information to their commanders in order to get permission to fire. The logs show clear evidence of a cover-up after the event.

Take the second round of shooting in the 38-minute sequence. It revolves around a dark-coloured minivan that approaches a wounded man lying by the pavement and trying to drag himself to his feet. Two men jump out and go to his aid. Neither is carrying a weapon. They pay no attention to the bodies lying several yards away. Yet the cockpit recording has their commander saying "they have individuals going to the scene, looks like possibly uh picking up bodies and weapons". The helicopters get permission to blast the van regardless, even though firing on people who are aiding casualties violates US rules of engagement and international law.

The intelligence report of the incident says Crazyhorse "engaged AIF". In fact there is nothing seen by the helicopter pilots to show the men are insurgents. Indeed, when US ground troops reach the shot-up van a few minutes later they discover its passengers include two small girls who have been wounded, suggesting it was an innocent civilian vehicle that had rushed to help the wounded victim because it was the nearest transport available.

The third bout of gunfire from the helicopters comes when they destroy a large building on a street corner with three Hellfire missiles. Before firing the first one the pilot says: "There are at least six individuals in that building with weapons." The cockpit video has shown only one man going into the building, carrying something that might be a weapon. Two clearly unarmed men then go in and another unarmed man walks past the entrance seconds before the gunner launches his missile. Over the next few minutes the helicopters fire two more missiles in order to destroy the building completely.

As untrue as the helicopter pilots' live reporting was, the intelligence summary they filed later compounds the lies. Now the alleged gunmen are said to have been running into the building – clearly more suspicious behaviour than walking.

In the report's own laconic language: "1125: Crazyhorse engaged with 3xMissle 6XAIF with wepons that ran into a building at Grid MB 5514 8626. Building destroyed 6x AIF KIA".

Prominent Kurdish Figure Says Kurdish Future is Not Optimistic in Iraq

17/10/2010 By RUDAW

ERBIL, Iraqi Kurdistan: A prominent retired Kurdish politician and intellectual says that Kurds could face tougher times in the future, their issue is yet far away from resolution, and their preference should be the Shiite parties to form a new government.

Jawher Namiq Salim, the first speaker of the Kurdistan Parliament that was elected in 1992-following the mass uprising of the Kurds against former Saddam Hussein’s regime- warned that the future for Kurds is increasingly looking not optimistic.

“Looking at the past of Maliki would not make us feel optimistic, but looking at [Iyad] Allawi, the people in his coalition and the positions that they take would disappoint us,” said Salim in an exclusive interview with Rudaw in Erbil, the capital of the Kurdistan region.

“With all the negative aspects Maliki, his coalition or [the Shiite] National Alliance have, they are incomparable to Iraqiya, its parties and figures,” said Salim adding “In reality, Iraqiya is a base for the Sunni Arab chauvinists and racists who are all former Ba’athists.”

Seven months have passed since elections were held; Iraqi political parties are yet to agree form a coalition government.

Though, Maliki looks to be able to form a government with the support of the Kurds after he has reached an agreement with the Sadr Movement, he does not seem to want that without the backing of Sunni Arabs fearing the resurgence of a sectarian conflict Iraq suffered following 2003-US-led invasion.

The Kurds, for their part, have not openly preferred any Arab candidate to others. They rather say that anyone could win their backing if they support a 19-demand paper that they have sent to the Arab wining parties.

But Salim says this way of politics Kurdish leadership does is wrong.
“They are spectators not players,” he said adding, “They say they are not part of the problem but of part of the solution.”
“On of the major problems of Today’s Iraq is Kurdish issue, though.”

As Salim prefers Maliki’s State of Law to Allawi’s Iraqiya, spokesperson of Iraqiya threatens Kurds that their support to Maliki would make Iraqiya not help resolve the issue of the disputed regions where it enjoy a strong support from Arabs and Turcomans.

“If they [Kurds] form an alliance with Maliki, they will lose, in particular, the issue of the disputed regions,” said Mayson Damalochi, spokeswoman for Iraqiya.

O bizimle yaşayacaktır onun mezarı şehit olarak yeri cennettir o Allah’a inanırdı davasına milletine sahip çıkmaktaydı.
O her zaman bizim içimizde, duygumuzda gönlümüzdedir ölmeyecek yaşayacaktır.
