140. madde'nin yasal ve kanuni olarak bittiği takdirde, Kürt sorumluları, ölen cesedi tekrar diriltmek için -çelişkili bile olursa- durmadan açıklama yapmaktalar, bu konuda Dr. Fuat MASUM, 140. madde kalıcıdır zamanı geçerse bile eskitilemez dedi, sonra da herhangi bir Anayasa Maddesinin uzatılması Irak Millet meclisi'nin değil Anayasa Düzeltme Komisyonu'nun yetkisidir diye ekledi.


Bir Maddeni uzatılmasını Herkesten (Millet Meclisi) olumsuz tutmak fakat (Bir kesime) Anayasa Düzeltme Komisyonu'na öz tutması çelişkili bir mantık, yetkisi uzatmak değil ama düzeltmek önerisin de bulunmak bu komisyonun başkan yardımcısı, Fuat MASUMUN bu gibi yanlışlara düşmemesi gerekmektedir.Uluslar arası Güvenlik Meclisi'nin 10.08.2007 tarihli 1770. kararına dayanarak Birleşmiş Milletler'in ne 140. maddeye ne de Irak iç işlerine karışmalı fakat öneri ve yardımda bulunmalı kararını, Fuat Masum bilerek unutmaktadır.Evrak karıştırmayı amaçlayanların da bilgilerine, 140. maddenin (6) ay uzatması Irak Millet meclisi tarafından değil ama Kerkük ve diğer Irak Bölgelerine Karışmak hakkına sahip olmayan (Kuzey yönetim Parlamento) tarafından gerçekleşti, ki bu uzatma yetkisine sahip değildir.

Kerkük pırıl pırıl parlayan Türkmen rengi ile Irak'ın bir şehridir. Başka bölgelere tabi tutma çabaları, Tarih ve Coğrafya gerçekleri üstüne atlamakla netice getirmez ve Irak'ın toprak ve halk bütünlüğü içinde kalacaktır.

Topics: Kerkuk is a city rich in both oil and history. Home to Turkmens, Kurds, Arabs, Chaldeo-Assyrians, and other indigenous communities, Kurdish claim of the city is at present subject to both conflict and controversy. The Turkmen and Arab leaders, citing their historic presence in the city, have expressed opposition in particular to its proposed inclusion in the nearby Kurdish region.
Selecting from article 58 of the Transitional Administrative Law (TAL) for Iraq, article 140 of the Iraqi constitution was extracted to mandate a resolution of this dispute through a process of normalization and a census, followed by a referendum to be held no later than 31 December 2007. This mechanism had however proved largely ineffectual and was not realized. The referendum appears as a consequence potentially set to deliver yet further instability and volatility.

The shortcomings of the process so far stem in part from a failure to define adequately a number of the key provisions outlined in article 140; the link between the components of normalization, census, and referendum; eligibility to vote; the threshold needed for a decision; and the boundaries of voting districts. Most crucially however, there has been little discussion of what options are to be presented to voters in an eventual referendum. This, in particular, has resulted in discussions reducing to a simple dispute between those who would see Kerkuk included in the Kurdish region and those who oppose this. There has consequently been little room for constructive compromise.

Acknowledging that the prevailing status-quo serves none of its citizens, Iraqi Turkmen participants opposed to the city’s inclusion in the Kurdistan region will be invited to present a proposal by which Kerkuk might be administered as a distinct Governorate or federal region within Iraq. This is already the solution preferred for Baghdad, as well as many other disputed cities around the world.

Iraqi Turkmens have remained marginalized during the process of reconstructing the Iraqi state after 2003, arguing that relatively little has been achieved with respect to correcting the past injustices they have suffered. The recent waves of disproportionate Kurdish immigration into Kerkuk raises suspicions of the role this might play in the imminent referendum on the city’s future status.

The conference would aim therefore to begin a process of rephrasing the discussion of Kerkuk’s future status in more constructive terms, principally by offering an alternative picture of its final status.

This conference aims to convene representatives of Iraq’s new institutions with European policy makers with an interest and opportunity to influence the reconstruction of the Iraqi state. The concerns of the Kerkuk’s Turkmens and Arabs will be presented by some of their most prominent figures in an effort to ensure that the next crucial steps in the reconstruction process proceed in a manner consistent with the principles of democracy, human rights, and the genuine inclusion of all affected not-ruling communities (minorities) in the region. These are principles without which a stable Iraq will inevitably remain illusive.

FRANSA, ERBİL'DE DİPLOMATİK TEMSİLCİLİK AÇTI

Fransa, Dışişleri Bakanı Bernard Kouchner'in de Katılımıyla Irak'ın Kuzeyindeki Erbil Kentinde Temsilcilik Açtı.

Fransa, Dışişleri Bakanı Bernard Kouchner'in de katılımıyla Irak'ın kuzeyindeki Erbil kentinde temsilcilik açtı.
Irak Cumhurbaşkanı Celal Talabani ile görüştükten sonra Erbile'e gelen Kouchner, Erbil havaalanında Bölgesel yönetimin Başkanı Mesut Barzani ve bölgesel yönetimin temsilcisi Neçirvan Barzani tarafından karşılandı.

Parlamento binasına geçerek Neçirvan Barzani ile görüşen Kouchner, daha sonra bölgesel yönetimin meclis başkanı Adnan Müftü ile bir araya geldi.

Erbil Valiliği yakınlarında bulunan Fransa diplomatik temsilcilik binasına gelen Kouchner, burada yaptığı konuşmada, Fransa'nın Irak'la olan ilişkilerinin eskiden olduğu gibi bundan sonra da devam edeceğini, Fransa'dakİ şirketleri buraya gelmeye teşvik edeceklerini bildirdi.

Bölgesel yönetimin temsilcisi Neçirvan Barzani de, hiçbir zaman Fransa'nın kendilerini unutmadığını bildirdi.

Onların desteklerine her zaman ihtiyaçları olduğunu ifade eden Neçirvan Barzani, şöyle dedi:
''Burası çok zengin bir ülke. Sadece petrol var diye yardım edilmesin. Diğer konularda da yardımlarını bekliyoruz. Sadece ilişkiler siyasi konularda kalmasın, kültürel ve ekonomik ilişkiler de olsun. Dost ve yakın bir ülke olan Fransa, burada diplomatik temsiliğini açarak bize daha yakın oldu. Umarım yakında da buraya konsolosluklarını da açarlar.''

Konuşmaların ardından Fransa diplomatik temsilciliği törenle açıldı.

Kouchner, daha sonra Selahaddin kentine geçerek burada bölgesel yönetimin başkanı Mesut Barzani ile görüştü.

Barzani görüşmenin ardından düzenlenen basın toplantısında Kouchner'in ziyaretinden büyük memnunluk duyduklarını söyledi.

Kouchner de Kerkük ile ilgili bir soruyu, şöyle yanıtladı:

''140. madde Anayasal bir maddedir ve uygulanması lazım. BM'nin de önerileri vardır ve bunlar da göz önünde tutulması lazım. Biz bu sorunun çözülmesini istiyoruz. Barzani'nin 140. maddeyle ilgili fikrini de destekliyoruz. Kürtler, Irak'a demokrasi yolunu öğretti ve Irak'ın Kürtlerin demokrasi modelini uygulamaları lazım. Ancak bu şekilde rahata kavuşurlar.''

Turcoman MP welcomes Kurdish PM statements on Kirkuk power sharing

Turcoman Lawmaker Fawzi Akram Tarzi on Wednesday welcomes statements of Iraq’s Kurdistan Prime Minister Negervan Barazani, during which he expressed Kurdish readiness to share all ethnic groups in ruling Kirkuk.


“The Turcomans received Barazani’s statements with great optimisms and the Turcoman leaderships realized that the Kirkuk cause will not be solved without understanding as well as to take into consideration the privacy of the city,” Tarzi, a Sadrist, told Aswat al-Iraq – Voices of Iraq (VOI).


Barazani had expressed in statements from Dubai yesterday the Kurds’ readiness to share power with Arabs in the city of Kirkuk,, highlighting the importance role of the U.N. to solve this cause.


The Turcoman MP voiced belief that in case these statements implemented would contribute in realizing peace and security throughout Kirkuk.


Article 140 of the Iraqi constitution is related to the normalization of the situation in Kirkuk , an important and mixed city of Kurds, Turkmen, Christians and Arabs. Kurds seek to include the city in the autonomous Iraq's Kurdistan region, while Sunni Arabs, Turkmen and Shiite Arabs oppose the incorporation. The article currently stipulates that all Arabs in Kirkuk be returned to their original locations in southern and central Iraqi areas, and formerly displaced residents returned to Kirkuk, 250 km northeast of Baghdad.


A referendum, provided for in the Iraqi constitution, was scheduled to be held by the end of 2007 on including the city into the Kurdistan region, but was postponed for six months.
Iraq 's Kurdistan region includes the provinces of Arbil, Sulaimaniya and Duhuk. It has a Kurdish majority population in addition to Turkmen, Arabs, Christians and Chaldean-Assyrians, constituting one fifth of Iraq 's 27 million population, according to figures released by the Independent Electoral Commission of Iraq.

Ergeç meets De Mistura in Baghdad

During his presence in the capital Baghdad the Iraqi Turkmen front leader and the member of the Iraqi House Representatives, Dr. Saadettin Ergech has met with the senior Special Envoy of the Secretary-General of the United Nations in Iraq (Staffan de Mistura).


During the meeting which was also attended by senior Baghdad official of the Iraqi Turkmen Front, Aydin Aksu, ongoing preparations for holding elections of provincial councils in Kirkuk and Turkmen areas were discussed.


In Dr Ergech's agenda to De Mistura were issues of unresolved question of ownership and the city of Kirkuk and the notorious Article 140 from the Constitution, which lost the power of legitimacy by the end of 2007 the deadline.


In a private interview with Turkmen Eli TV in Baghdad Dr. Ergech said that this meeting came according to an invitation from United Nations bureau in Iraq and that focuses on issues that concern the Turkmen people, especially the issue of Kirkuk city and upcoming local elections .


Ergech also transferred to UN that the Turkmens will not back off their just demands and their rights in all the regions of Kirkuk and Turkmen Eli, and that Article 140 has lost its legitimacy constitutionally after the end of the ceiling set time for its application, pointing out that reliance on the results of the census in 1957 is the basic formula to be followed in determining the fate of Kirkuk .
